Official Rules

The 30 Day Tour short film challenge is organised by Screen My Shorts Inc, a not for profit organisation trading as Veterans Film Festival, also known as Veterans’ Film Festival – ABN 40 930 405 614, 14 Lamont Lane Bermagui NSW 2546. (‘SMS’, ‘VFF”, ‘We’, ‘Us’, ‘Our’)

30 Day Tour short film challenge offers filmmakers the freedom to explore diverse perspectives and create short films that tell stories and raise awareness about serving and ex-serving Defence Forces personnel, their families and our society. 30 Day Tour short film challenge is a competition which is open to all ages, cultures and ability from around the world to submit original creative work and win a share of the cash and other prizes awarded.

1.    The Challenge
30 Day Tour short film challenge invites all creative types from around the world to write, shoot, edit, produce and submit a short film in just 30 days, known as the (‘Challenge’). An entry can take any form, be it short film, machinima, documentary, animation or digital art, and is bound by a subject, include a signature element, with a designated duration, be made, submitted and accompanied by all necessary documentation within 30 days and must be made specifically for Challenge, together hereafter known as ‘Entry’ or ‘Film’.

1.1    Genre
The Entry may be made in the genre of the Filmmaker’s choice.

1.2    Subject
When registering, filmmakers must nominate two (2) different numbers containing subjects that they would like to make their film about. The numbered subjects are:

  1. Biography / History
  2. Commemoration / Remembrance
  3. Contraband / Going AWOL (Absent With Out Leave)
  4. Indigenous / Cultural Diversity
  5. Disability / Health / Mental Health / Homelessness
  6. Enlisting / Being drafted / Going to war / In a conflict zone / Homecoming
  7. Family / Children / Widow / Widower
  8. LGBT – Lesbian, Gay, Bisexual, Transgender
  9. Living with war today / Your view on war
  10. Women – Serving / Ex-serving / Civilian
  11. Medical personnel
  12. Peacekeepers
  13. Commemorating First World War / ANZAC (Best Film $500)

Note: Teams that select only one (1) number will be disqualified.

1.3    Signature Element

Note: Participants in the VFF will be randomly assigned one (1) subject from their choice at the beginning the competition [7 pm (19:00) local time of each participating Producer’s or town] that they must make their film about.

1.4    Duration of Entry

  • Entries for 16 years and over – short film not exceeding 8 minutes duration including credits.
  • Entries for Junior Challenge for 15 years and under – short film not exceeding 4 minutes duration including credits.

1.5    The VFF only accepts an Entry that is uploaded to a Dropbox folder provided by Us. We do not accept an Entry submitted on a USB/DVD/Hard drive or other media or internet platforms such as Youtube or Vimeo.

1.6    Use of weapons

If weapons are to be incorporated in an Entry, Producer is required to take all associated safety precautions and exercise due diligence in the making of an Entry, for VFF and its Challenge, and make contact with and inform all relevant and necessary authorities that oversee the area of the filmmaking location, be it interior or exterior, publicly or privately owned, and provide VFF with documentary evidence (Use of Weapons form) of this contact, including name of organisation, authorised contact person, email, phone number and date of contact, when submitting the Entry. This form also requires details of all weapons and materiel involved in the making of an Entry. For further information see – Use of Weapons

Producer hereby agrees to indemnify, defend, and hold harmless VFF, its owners, officers, directors, shareholders, employees, licensees, partners and assigns (collectively “Indemnified Parties”) from any and all claims, costs, damages, expenses and liabilities including without limitation attorneys’ fees (collectively ‘Claims’) arising from the use of weapons if any caused to or by person/persons, including personal or physical harm to any or all third parties, taking part or attempting to take part in the making of an Entry and/or material/s and/or location/s that may be used in the whole or any part of an Entry whether used or not and any and all such claims will not be deemed to be irreparable or otherwise sufficient to entitle Producer to seek injunctive or other equitable relief from VFF.

1.7   Language
We accept films in any language…however, films not made in English require English subtitles.

1.8   Documentation
The following forms are to be completed and submitted with your film:

  • Producer’s Agreement: Producer signs this form on behalf of their participating person/team/group, to indicate agreement with the Veterans’ Film Festival Official Rules, Guidelines and requirements.
  • Team Details (Cast and Crew): Who is on the team, their role/job and their e-mail address.
  • Release and Limited Liability Agreement: All cast and crew must sign this form regarding talent/appearance, location, music and materials used e.g. soundtrack, photographs and other materials.
  • Classification Form: Summary of plot and thorough explanation of the film’s content
  • Wrap Up Form: Survey and Questionnaire.
  • Filmmaker’s Checklist: Producer’s confirmation of completion of all necessary tasks and documentation.
  • Use of Weapons – A form which includes details of weapons and materiel used and name of organisation, name of authorised contact person, title, email and phone from relevant police, local council departments and film authority.
  • Production photos: Colour production photos of cast, crew and behind-the-scenes – giving the organisers of the Veterans Film Festival the right to use, publish, reproduce, edit these photos for promotional purposes in any/all media/internet platforms, now known or later developed, in perpetuity.
    SAG-AFTRA Waiver – USA filmmakers only: Ensures Producer has the relevant Waiver from the Screen Actors Guild – American Federation of Television and Radio Artists, if required.
    Use of Weapons: Form provided by VFF containing details of weapons and materiel used and their contact with local authorities regarding any use of weapons in Entry – only required if weapons used.

Note: Films submitted without completed required Documentation by the Deadline will not be regarded as eligible Entries.

2.    Eligibility
2.1    Only one designated person, known as ‘Producer’, representing and on behalf of a person/group/team, may register for the Challenge and accept the relevant terms and conditions and any specific rules, including the Guidelines, Official Rules, Producer’s Agreement and other details contained in the Documentation relating to this Challenge or to the prizes, published on Our Website and in any media which features this Challenge, together the Guidelines and Official Rules (together ‘Rules’).

2.2    An Entry must be Your own work, not be copied, not contain any third party materials and/or content that You do not have permission to use and not infringe on any copyrights. By submitting an Entry, a Producer agrees to the Rules, and further agrees to indemnify and hold Us, partners and their respective affiliates, officers, directors, agents, co-branders or other partners (‘Partners’), and any of their employees (collectively, the ‘Challenge Indemnitees’), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys’ fees) and liabilities (including settlements), brought or asserted by any third party against any of the Challenge Indemnitees due to or arising out of the Producer’s Entry materials in this Challenge, or the Producer’s conduct during and in connection with this Competition, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. The Producer agrees to release, indemnify and hold harmless Us and Partners from any and all claims that any advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Us or the Partners infringes on the rights of the Producer’s work as contained in any Entry. Entries must not be obscene, defamatory or in breach of any applicable legislation or regulations. The Film is to be classified as G or PG, at most. If We have reason to believe Your entry is not Your own work or otherwise breaches this clause 2.3, then We may not consider it.

2.3    VFF reserves in its sole discretion the right to not accept or disqualify an Entry that We do not believe is suitable for the Challenge.

2.4    Classification
Films made for the VFF may be seen by children under the age of fifteen (15) years of age. Therefore, the VFF only accepts films that are classified as having a G or PG rating.

General (G) – The G classification is suitable for everyone. G rated content may contain classifiable elements such as language and themes that are very mild in impact.

Parental Guidance (PG) – The impact of PG (Parental Guidance) classified films and computer games should be no higher than mild, but they may contain content that children find confusing or upsetting and may require the guidance of parents and guardians. They may, for example, contain classifiable elements such as language and themes that are mild in impact. It is not recommended for viewing or playing by persons under 15 without guidance from parents or guardians.

It is the Producer’s responsibility to ensure that the film made for the VFF complies with a G or PG rating. For more details, please visit www.classification.gov.au

2.5    Important Dates:

  • 21 August 2015 – known as the ‘Kickoff’ – Friday at 7.00 pm (19:00) local time of the Producer – Producers will receive one of their nominated subjects. Those registering after this date will receive from Us their subject and element as soon as possible.
  • 20 September 2015 – known as ‘Deadline’ – Sunday at 12.00 Midnight (24:00) local time of the Producer – Entries are to be uploaded by this time to a Dropbox folder provided by VFF. Entries received after the Deadline will not be considered.
  • 11 October 2015 – Notify Producers whose Entries have been selected for the Short List.
  • 20 October 2015 – Notify Short List Producers whose Entry have or have not been selected as a Finalist.
  • 11 November 2015 – Festival Night and Awards Ceremony, starting at 7.00pm.

2.6    A Producer is responsible for the cost (if any) of uploading Your Entry to Us.

2.8    If a Producer on a team is under 18, one of their parents or legal guardians must act as their Producer and enter via the online form.

2.9    By entering this Challenge and taking part in the activities relating to receiving a prize, the Producer agrees to take part in or co-operate with a reasonable amount of publicity or other promotional activity on behalf of Us and agree that We may publish the Producer’s name/s and hometown and any photograph/s, Film/s and/or recording made by Us or on Our behalf and featuring the Producer and/or member/s of the team.

2.10    The Challenge is not open to Partners, employees, directors, management, agents, licensees, retailers, suppliers and contractors of SMS, VFF, or any person directly or indirectly involved in the organisation or production of the Challenge or their family members.

2.11    We reserve the right to verify the eligibility of and/or disqualify a designated Producer or Entry at Our discretion, at any stage of the VFF and the Challenge included.

2.12    The Producer confirms and agree that:

  • They are eligible to enter the Challenge
  • All details contained in the completed and submitted Registration Form and all Documentation are true and correct
  • The Entry does not defame, misrepresent, contain disparaging remarks or other content that could adversely affect the name, reputation or goodwill of VFF and their Partners
  • SMS determines what is inappropriate content, regardless of classification
  • All performers in any Entry have given their written consent to the use of their performances in the Entry
  • The Producer has obtained written consent from all contributors of copyright material used in their Entry to their material being edited, altered and reproduced by the Producer and anyone they permit to do this, including VFF, to the extent permitted by applicable law
  • We retain the right to use any Entry as we see fit without any obligation to any Third Party, their charges, other limitations or agreements

2.13    If a registered Producer is unable to continue in that role for any reason whatsoever, or is removed from that role due to disqualification, the group/team he or she represents may designate another Producer who may submit a new Producer’s Agreement and assume the duties entailed for the continued involvement of the Entry in the Challenge.

2.14    Slate
Pre-film required Slates: Before the finished Entry begins, the film must have…

  • 2 seconds of black
  • A title card with: team name, title, subject, genre, city, duration and date
  • A title with: ‘This film was made for Veterans Film Festival’
  • 2 seconds of black
  • Then the film begins

3.    Registration

3.1    By entering the Challenge, a Producer unconditionally indemnifies Us and designated partners/sponsors/parties and associates/representatives and hold harmless from any and all claims, damages or liabilities arising from or relating to such Producer’s participation in the Challenge and the VFF, and must pay Us on demand the amount of all losses, liabilities, expenses and taxes that We may suffer (including the cost of settlement and any legal expenses on a full indemnity basis) because any of your representations or warranties are incorrect, a breach of the Official Rules and the Guidelines, or because of a claim or proceeding by another person against Us caused or contributed by a Producer.

3.2    Enter online and pay the Entry fee via PayPal.
We only accept payments through PayPal. Fees to enter are:

  • Machinima – AU$00.00 NIL (Machinima entries are sponsored by University of Western Australia – UWA, therefore the fee is waived).
  • Eighteen (19) years and over – AUD$50.00
  • Film School Students, Unemployed and Concession (subject to proof of ID supplied) – AUD$30.00
  • Sixteen to eighteen (16 to 18) years (subject to proof of ID supplied) – AUD$20.00

Junior 30 Day Tour Entry Fees (Short film not exceeding 4 minutes duration including credits) Junior filmmakers entering the competition must have their parent/guardian fill out the registration form.

  • Fifteen (15) years and under – AUD$15.00

REFUND POLICY – No refunds will be offered for any reason.

3.3    All Entries and Documentation are to be uploaded to a Dropbox folder provided by the organisers using the file name ‘Veterans Film Festival ENTRY NAME’. Producers are required to send a notification of the upload to info@veteransfilmfestival.com.

3.4    Films must use the following format criteria:

  • Film Format to be 16 x 9 aspect ratio Resolution & Compression 1080p – 1920 wide x 1080 high
  • File Format – H264
  • Camera Settings – PAL 24 or 25 Frames per second
  • Audio – 48kHz (or 44kHz), 16-bit, stereo files.

3.5    An Entry is to be made specifically for the Challenge and the VFF, with its first screening and viewing at the VFF Awards ceremony, and any Entry will automatically be disqualified if it is screened or distributed in any way, such as uploading the film to any/all media/internet platforms, now known or later developed, before and other than for Veterans’ Film Festival Awards ceremony.

3.6    No Entry or Documentation will be returned.

3.7    Limitations of Liability
No liability or responsibility is assumed by Us or Partners resulting from any user’s participation in or attempt to participate in the Challenge or ability or inability to upload or download any information in connection with participating in the Challenge. No responsibility or liability is assumed by Us or Partners for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Challenge: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any providers of Internet services, servers, file hosting services or cloud storage; garbled, jumbled or faulty data transmissions; failure of any email transmissions to be sent or received; lost, late, delayed or intercepted email transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Challenge, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Challenge, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Challenge. We and Partners are not responsible for any typographical errors in the announcement of prizes or these Rules, or any inaccurate or incorrect data contained on the Website. Use of Website is at user’s own risk. We and the Challenge Indemnitees are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer equipment resulting from participation in the Challenge, use of the Website or the download of any information from the Website. By participating in the Challenge, Producer agrees to release, indemnify and hold Us and Partners harmless from any and all claims, damages or liabilities arising from or relating to such Producer’s participation in the Challenge via any and all media/internet platforms, now known or later developed. In Addition, the Filmmaker understands that the Entry will be retained in a secure facility by the VFF, and every effort without obligation or responsibility will be taken to protect and control the viewing of the Entry. VFF assumes no liability whatsoever for theft, copyright violations or piracy of the Entry and is not responsible for any and all malfunctions during the presentation of the Entry at the Awards Ceremony.

3.8    VFF will not be liable for any special, indirect or consequential damages, without limitation, damages arising under any Claim or cause of action, including contract, warranty, strict liability or tort, whether or not VFF has been advised of the possibility of such damages. Furthermore, it is understood that VFF’s total liability for any Claims and/or causes of action shall not exceed, and is limited to, the total amount paid to VFF in entry fees by Producers under this agreement. These limitations shall apply notwithstanding the failure of the essential purpose of any limited remedy.

4.    Compliance
4.1    Films are to be about the central theme and align with the subject and element allocated to the Producer at the beginning of the Competition – Clause 1.

4.2    Producers are responsible for ensuring that their group/team members actively involved in making an Entry understand, agree and comply with the Official Rules, Guidelines, all Documentation and all information as they appear on this Website.

4.3    Producers agree to have their Entry shown on the Our or any other Website, social media sites and on any/all media/internet platforms now known or later developed that We designate as suitable, and commented on by users.

5.    Releases
5.1    Producers declare that they have obtained all required permissions and clearances in writing and/or online from any person/party/organisation participation in, attempt to participate in or ancillary to the Challenge, including cast and crew, music, location, lighting, materials, sound and/or images and any other creative work presented in the film.

5.2    Producers ensure that all clearances pertaining to the Entry allow for its use in all promotional/commercial/non-commercial events, screenings, media and internet platforms now known or later developed, throughout the universe in perpetuity.

5.3    Entry/Entries may be chosen by Us for display at various promotional/commercial/non-commercial events, screenings, media and internet platforms now known or later developed throughout the universe in perpetuity and by taking part in the Challenge, the Producer agrees that an Entry or part thereof may be displayed as We require/desire.

5.4    Producers working in the USA must secure the relevant Waiver from the Screen Actors Guild – American Federation of Television and Radio Artists, if required.

6.    Judging
6.1    A judging panel which may include Us, representatives from the film industry for their experience and professionalism, associated and diverse professionals and Sponsors/Partners (hereafter known as the ‘Jury’).

6.2    We reserve the right to vary the number and nature of award categories at Our discretion.

6.3    The judging criteria:

  • Artistic Merit (e.g. Story, Creativity, Entertainment value) – 50%
  • Technical Merit – 40%
  • Adherence to chosen Subject – 10%

6.4    After the Deadline, the Entries will then be processed by Us and the Jury, as follows:

  1. A Short List is created from the Entries and the number on the Short List may vary at Our discretion.
  2. The Jury then judges the Short List to reveal those Entries that are nominated for awards (‘Finalists’). The number on the Finalists may vary at Our discretion.
  3. The Jury votes on which of the Finalists will receive nominations for the awards to establish the Award recipients (‘Winners’) in each category.
  4. There can only be one Winner in each category, including the ‘Best Film Award’.

6.5    The decisions of the Jury regarding the Short List, Finalists and Winners are final and no correspondence will be entered into. Jury scores and assessments will not be made public by Us.

6.6    Finalists in line for any awards will be informed in good time before the Awards Ceremony. Finalists may be required to provide additional documentation to the Documentation submitted with the Entry or follow-up information, before being officially nominated.

6.7    Finalists may be required to take part in reasonable publicity activities after the announcement of their award/s on behalf of Us.

6.8    Winners of awards agree to be filmed, photographed or recorded and grant Us, at no cost, the right to publish the Winner/s in part or in its entirety, footage, photographs or audio online and in all known media and internet platforms anywhere in the universe at any time, as required for the purposes of promoting the Challenge and the VFF and We may edit, adapt, translate or remove the Film at any time from such use.

6.9    The VFF reserves the right to reveal the Short List, Finalists and Winners in their categories in any way it chooses and on any/all media/internet platforms now known or later developed.

6.10    Details of the Short List, Finalists and Winners may be published on Our Website (www.veteransfilmfestival.com) at Our discretion.

7.    Awards
7.1    We may vary (add or withdraw) awards at any time during the Challenge and the VFF.

7.2    We may choose at our discretion to vary prizes by giving cash or in kind prizes. In the event of unforeseen circumstances or circumstances outside our control, We may offer an alternative prize of equal value.

7.3    Prizes may be listed on the Our Website and may be subject to change.

7.4    Awards at the final event (‘Awards Ceremony’) will be offered for each nominated category as listed on our Website. Other awards may also be given at Our discretion.

7.5    We reserve the right to design, manage, promote and announce the program and format of the Awards Ceremony and Winners as We see fit and no correspondence or discussion will be entered into.

7.6    Prizes will be delivered to Winners within 120 days of them being notified. If a prize offer is not accepted by a Winner within a further 30 days it may be withdrawn.

7.7    Prizes cannot be exchanged or transferred by Winners and cannot be redeemed by them for cash or any other prizes. Winners must pay all other unreasonable costs associated with the prize and not specifically included in the prize.

7.8    VFF reserves the complete right to make changes in the program dates and times and to possibly not screen any Entry, despite it being selected for screening.

8.    User Generated Content (UGC) – terms and conditions of an Entry
8.1    Producers (‘You’, ‘Your’) grant to Us and Our successors, an Exclusive Licence to their Entry, including Your name, age and town or city of residence for the sole purpose of identifying You as the author of Your Entry and any other material and/or information and colour photograph/s submitted with Your Entry or otherwise provided by the You (together ‘UGC’). throughout the known universe, in perpetuity, to copy, reproduce, modify, adapt, and otherwise communicate it to the public and exploit Your Entry, and it may be made available to (amongst others) partners, sponsors and associates, private showings to industry professionals, production companies, agents, distributors and exhibitors, public screening/s, We may edit, translate withhold or remove the Film or any part of it, at any time from any such parties or use, on or from Internet services, servers, file hosting services or cloud storage, streaming, online broadcasting, any or all media/internet platforms now known or later developed, including, without limitation, and for the avoidance of doubt, on our Website/s and publicity materials, or to advertise, promotional rights (including trailers, clips and excerpts) and promote the Challenge, the VFF and its products and services, and to showcase Your Entry on television, video-on-demand, all forms of digital and electronic delivery, mobile transmission, airline, ship or hotel rights, domestic use video (including Blu-Ray, DVD, other types of videograms), or analogous/digital home video technology, now known or later developed, without Your consent.

8.2    Producers (‘You’, ‘Your’) grant to Us and Our successors, a Non-Exclusive Licence to Your Entry, including Your name, age and town or city of residence for the sole purpose of identifying You as the author of Your Entry and any other material and/or information and colour photograph/s submitted with Your Entry or otherwise provided by the You (together ‘UGC’). throughout the known universe, in perpetuity, to copy, reproduce, modify, adapt, and otherwise communicate it to the public and exploit Your Entry, and it may be made available to (amongst others) partners, sponsors and associates, private showings to industry professionals, production companies, agents, distributors and exhibitors, public screening/s, We may edit, translate withhold or remove the Film or any part of it, at any time from any such parties or use, on or from Internet services, servers, file hosting services or cloud storage, streaming, online broadcasting, any or all media/internet platforms now known or later developed, including, without limitation, and for the avoidance of doubt, on our Website/s and publicity materials, or to advertise, promotional rights (including trailers, clips and excerpts) and promote the Challenge, the VFF and its products and services, and to showcase Your Entry on television, video-on-demand, all forms of digital and electronic delivery, mobile transmission, airline, ship or hotel rights, domestic use video (including Blu-Ray, DVD, other types of videograms), or analogous/digital home video technology, now known or later developed, without Your consent.

8.3    If Your Entry is not selected for the Short List or as a Finalist, an Exclusive Licence pertaining to your Entry automatically becomes null and void on 1 November 2015 and all rights to Your Entry granted by You to Us automatically revert to You, and We, nor Our assignees or licensees, will not have any further rights, including copyright, to Your Entry.

8.4    If Your Entry is selected for the Short List though not as a Finalist, the Exclusive Licence pertaining to Your Entry you granted Us in UGC Clause 8.1. automatically becomes null and void on 11 November 2017 and You automatically grant to Us a new Non-Exclusive Licence and You accept and agree that the conditions exist to allow You to grant such Licence until 11 November 2019. You may apply in writing to Us to request this Non-Exclusive Licence granted to Us after 11 November 2017 be terminated.

8.5    If Your Entry is selected as a Finalist, the Exclusive Licence pertaining to Your Entry you granted Us in UGC Clause8.1 will continue in perpetuity.

8.6    If an Entry is selected for the Short List, the Producer and VFF agree that VFF may license, sell, or otherwise assign (‘license’) any rights in the Entry to a third party licensee and the following terms shall apply and as indicated in Clauses 8.4 and 8.5:

(a) Individual License (i.e. VFF licenses the Entry individually): VFF will receive the first AU$150 of any license fee and/or royalties or reuse fees received therefrom; Producer shall receive 25% of VFF’s net proceeds from the remainder (i.e. those in excess of AU$150) of such license fee and/or royalties/reuse fees.

(b) Collection (i.e. VFF licenses two or more Entries (‘Collection’) of which the the Producer’s Entry is one): If Producer’s entire Entry is included in the Collection, Producer will receive a pro rata share of 25% of VFF’s net proceeds there from. Pro ration will be dependent upon number of Entries included in the Collection.

(c) Sponsor License: Notwithstanding the foregoing, in the event the licensee of the Entry or Collection is a sponsor of VFF or the Challenge (‘Sponsor’) as determined by VFF, We will retain 100% of all proceeds, if any, from any such license.

(d) Official VFF DVD: If the Entry is included on a VFF compilation DVD, Producer will receive a pro rata share of 25% of net proceeds received by Us when more than 500 DVDs are sold. Pro ration will be dependant upon number of films included on said compilation.

8.7    VFF’s net proceeds, for the purposes of Clause 8.6 shall be defined, computed, paid and accounted for pursuant to Our standard definition, which shall include allowances for the deduction from gross receipts VFF’s customary deductions including, without limitation, distribution fees, distribution expenses, production costs and overheads. We shall make semi-annual (i.e. twice per year) reports to Producer, provided, however, that We need not issue a report if Producer has not accumulated revenue to report. We shall issue checks to Producer on a semi-annual basis so long as total revenue for a Team Leader has reached a minimum of $25.

8.8    Films selected for the Short List and which are not a Finalist, have not been, and will not be, available to be viewed by the public by any means, including by way of the internet, until the Exclusive Licence granted by the Producer to VFF under Clauses 8.4 terminates.

8.9    The UGC Terms include provisions in which You warrant that:

(a) You own the copyright to Your UGC as its author and represent and warrant that You have (and will continue to have during the duration of the Challenge and thereafter) all necessary licences, rights, consents and permissions We need in order to use Your UGC and You will provide evidence of such on Our reasonable request.

(b) Your UGC is Your own original work, and that it shall not infringe any copyright, third party rights including, without limitation, privacy and You will provide evidence of such on Our reasonable request.

8.10    We reserve the right not to publish or to cease to publish Your Entry for any or no reason including, without limitation, if We deem that Your Entry is in breach of any law or regulation or otherwise may create a liability for Us

8.11    By entering in the Challenge, You agree to allow Us to contact You for future information, news or activities. Your information will not be passed on to any third parties without the written permission of either You or Your parent or legal guardian if under 18.

8.12    The Producer retains at all times the ownership and control of the intellectual property of their Entry.

9.    Additional rules
9.1    In the event of You being nominated for the Short List, as a Finalist and/or Winner, You may be asked to sign a witness statement confirming that Your Entry is an original piece of work and that You hold all legal rights within the Entry. Failure to respond to such a request within 7 days or provision of false information may result in disqualification from the Challenge and an alternate Winner may be selected. Such statements of Winners under 18 years of age at the time of Award must be countersigned by a parent or legal guardian. All such statements will be subject to verification by Us.

9.2    We take no responsibility for Entries that are lost, delayed, misdirected or incomplete or cannot be delivered, entered or uploaded late for any reason. Proof of delivery of the Entry is not proof of receipt by Us.

9.3    The producer of the Challenge and the VFF is Us and any complaints regarding the Challenge and the VFF should be sent to the following addresses: info@veteransfilmfestival.com

9.4    We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by any person as a result of entering the Challenge, Awards Ceremony and the VFF or accepting any prize. We further accept no liability for any injury or damage to Your, nor any other person’s computer relating to or resulting from participation in or downloading or uploading any materials in connection with the Challenge and the VFF.

9.5    The Challenge will be governed by the laws of New South Wales, Australia and You irrevocably submit to the exclusive jurisdiction of the courts of that state.

9.6    If any part, term, or provision of these Rules shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect.

9.7    These Rules may be varied from time to time, at Our discretion, by our posting new terms on Our Website (www.veteransfilmfestival.com), and any such amendment/s will be applicable to all Producers from the date and time such revised terms have been posted on the Website. Producers’ continued use of the Website or services constitutes agreement with and acceptance of any such amendment/s or other changes.

9.8    These Rules shall be governed by and will be construed in accordance with the laws of the state of New South Wales, Australia. Any disputes arising under or in connection with these Rules shall be subject to the exclusive jurisdiction of the state of New South Wales, Australia.

9.9    These Rules constitute the entire obligations and understandings between the parties, including Producers, SMS, VFF, US, We, Challenge Indemnitees and Partners, on the subject matter hereof. There are no understandings, agreements, or representations, oral or written, not specified herein regarding these Rules.
